Submitting a Deferred Submittal

Definition

Deferred submittals are a portion of a construction design not included in the initial Building permit application and submitted after permit issuance for review and approval.

It is important to note: Deferred submittals differ from resubmittals and revisions.

  • Resubmittals of plans are responses to plan check comments related to projects that are still under plan review. (Please see Resubmittal of Plans for submittal information)
  • A revision to an issued permit is an update to the plans after a Building permit has been issued. (Please see Revision to an Issued Permit for submittal information)

     

Deferred Submittal Requirements

Per CBC section 107.3.4.1, all request for deferred submittals are required to be submitted at time of permit application for review and approval by the Building Official.

Documents associated with deferred submittal items shall be submitted to the registered design professional in responsible charge who shall review them prior to the documents being submitted for City review and issuance. The documents must include a notation indicating that the deferred submittal documents have been reviewed and found to be in general conformance to the design of the building. The deferred submittal items shall not be installed until the deferred submittal documents have been approved and issued. Deferred submittals shall be in accordance with the California Administrative Code, Chapter 7, Section 7-126.

Deferred submittals are required to be submitted, approved and issued prior to requesting an inspection for the work.

The City of Menlo Park only accepts on-line digital revisions of digital plans and supporting documents. All plans and supporting documents associated with a deferred submittal are to be submitted digitally through the City’s Accela permit management system using the Accela Citizen Access Portal (ACA). Deferred Submittal Process

 

  1. Contact the Permit Technician assigned to the record, and request for deferred submittal record be created. If you are unsure who the Permit Technician of record is, please contact the Permit Team.
  2. Follow all prompts to provide a narrative description of the deferred submittal and upload any files necessary for its review. 

It is important to note:

  • The Deferred Submittal record will have its own DEF### record number, which exists for the purposes of reviewing the deferred submittal itself.
  • All fees/inspections remain on the main record.
  • No fees are required upon submittal of a deferred submittal, but will be charged afterward, based on the plan check review time; payment of all outstanding fees is required before a project can receive its final inspection.
